New Senate bill would impose significant costs on universities for permitting encampments

Republican Senator JD Vance of Ohio is set to introduce new legislation that could have major implications for universities across the country. The proposed bill, known as The Encampments or Endowments Act, aims to crack down on encampments erected during anti-Israel demonstrations on college campuses.

Under the bill, schools that fail to promptly remove these encampments could face losing federal monetary assistance, including eligibility for financial aid programs under the Higher Education Act of 1965. This move comes in response to the escalating protests at universities, which have disrupted classes and school events.

Senator Vance emphasized the importance of upholding the law and protecting students from encampments that he believes are turning campuses into “garbage dumps.” The bill would also disallow schools from participating in Title IV programs if they do not comply with the removal of encampments.

The Department of Education has not yet provided comment on the proposed legislation. If passed, schools deemed ineligible would have to provide grant-based aid to students to make up for the lost federal aid, or face a tax equal to 50 percent of their endowment’s assets.

Republicans have been vocal critics of the anti-Israel demonstrations and encampments, as well as the handling of the protests by universities and the Biden administration. While President Biden and Education Secretary Miguel Cardona have condemned antisemitism in these demonstrations, they have not supported Republican calls for prosecution or deportation of the students involved.

The bill is set to be introduced amidst a wave of protests on college campuses, with over 2,200 people arrested or detained during demonstrations at 49 campuses in 26 states. The legislation aims to hold universities accountable for maintaining a safe and lawful environment for their students.
