Florida GOP State Senator Joe Gruters has proposed a bill that would ban smoking on the streets if voters approve Amendment 3, which would legalize marijuana for adults. Gruters announced the potential legislation during a virtual news conference, citing environmental and quality-of-life benefits as reasons for the ban.
Currently, smoking in indoor workplaces is already banned in Florida, and cities and counties have the authority to restrict smoking at beaches and parks they own. Gruters’ bill would extend the ban to all public spaces, including streets, sidewalks, and parks, if passed.
The proposed legislation would also ban vaping in public places. State Senator Darryl Rouson, a Democrat, plans to co-sponsor the bill with Gruters.
Gruters’ support of Amendment 3, which would allow anyone 21 years or older to possess, buy, or use marijuana products for personal, non-medical use, puts him at odds with Florida Governor Ron DeSantis, who opposes the measure. DeSantis has expressed concerns about the impact of marijuana legalization on quality of life, citing examples from other states where similar measures have been implemented.
If passed, Gruters’ bill would establish guardrails to protect the public if Amendment 3 becomes law. The proposed ban on smoking and vaping in public spaces is seen as a way to improve the overall environment and quality of life for residents in Florida.
